Item I of Article 8 of the Regulations on Administration of Funeral and Interment promulgated by the State Council in 1997 has made general provisions on the authority for approvals on the construction of funeral halls, crematorium, funeral service stations, cremains halls, cemeteries and other funeral facilities. In order to enhance the administration of the use of foreign capital to construct funeral facilities, Item 2 of Article 8 has, on the basis of the preceding item, imposed special provisions on the authority for approval of constructing funeral facilities using foreign capitals. On July 4, 2010, the State Council issued the Decision on the Fifth Batches of Projects for Which the Administrative Approval Shall Be Cancelled or Transferred to the Subordinate Level of Administrative Authority (Guo Fa〔2010〕No. 21) and abolished 113 administrative approval projects, including the approval requirement for construction of funeral facilities using foreign capitals. Therefore, as from July 4, 2010, the special provisions of Item (2), Article 8 of the Regulations on Administration of Funeral and Interment shall no longer be applicable to the authority for approval of the construction of funeral facilities using foreign capital. The general provisions of the Item (1), Article 8 of the Regulations on Administration of Funeral and Interment shall govern.
1997年國務(wù)院頒布的《殯葬管理條例》第八條第一款對殯儀館、火葬場、殯儀服務(wù)站、骨灰堂、公墓等殯葬設(shè)施建設(shè)的審批權(quán)限做了一般性規(guī)定。為加強(qiáng)對利用外資建設(shè)殯葬設(shè)施的嚴(yán)格管理,第二款在前款基礎(chǔ)上,對利用外資建設(shè)殯葬設(shè)施的審批權(quán)限做了特殊規(guī)定。2010年7月4日,國務(wù)院下發(fā)的《關(guān)于第五批取消和下放管理層級行政審批項目的決定》(國發(fā)〔2010〕21號),取消了包括利用外資建設(shè)殯葬設(shè)施等113項行政審批項目。因此,自2010年7月4日起,各地利用外資建設(shè)殯葬設(shè)施的審批權(quán)不再適用《殯葬管理條例》第八條第二款的特殊規(guī)定,而應(yīng)當(dāng)按照第八條第一款的一般性規(guī)定執(zhí)行。
