Dear Mr. Hellper:
Please be advised that this firm represents Ms. Also Injured in the above referenced
matter.
We are in receipt of your letter dated April 27, 2006, in which you demanded
payment of USD $7,500 from our client that you claim is owed under your right of
subrogation.
Upon review of the file, it appears that at the very least the accident occurred due in
part to the negligence of your insured. Quite possibly, your insured’s negligence
was the sole cause. Either way, Mr. Hert would not be entitled to recover from our
client. Consequently, no payment shall be forthcoming.
If you would still determine that you must pursue legal remedies, we are prepared to
file a counter claim against your insured for the full amount of our client’s losses,
which include property damages and personal injury.
