Notice of Claim
Date of Incident: 15/04/2004
Your Honorable Mark Brown:
This letter shall serve as official notice, pursuant to N.Y. Code Section 11-412 (1992
Rev. & Supp. 1995), of the following un-liquidated damage claim against the U.S.
Border Patrol.
On or about Aril 15, 2004, at approximately 3:00 p.m., Mrs. Aigohit Wang, a
middle-aged female citizen of the People’s Republic of China, was on a sightseeing
tour around the Niagara Falls, on the U.S. side of the Falls. While walking
southbound on the west sidewalk abutting the bridge toward Canada, she was
approached by two officers of the U.S. Border Patrol. The two officers, in a very
threatening manner and without warning, tried to grab Mrs. Wang and have her
handcuffed. In the ensuing wrestling and pushing, Mrs. Wang was brutally battered,
her face scared, eyes bruised and swollen, nose bleeding profusely.
Mrs. Wang was immediately taken into custody by the two officers and placed under
ward in an unidentified U.S. Border Patrol building. She was released the next day,
on April 16, 2004, without any explanation given or even an apology.
As an additional point of reference, Mrs. Wang entered the United States on April 12,
2004, on a valid B1/B2 tourist visa issued by the U.S. Embassy in Beijing. This wasMrs. Wang’s first entry into the U.S., and she has committed no wrong or crime
either in the U.S. or in China; neither has U.S. Border Patrol or any U.S. government
agency claimed any wrong or crime on her part, so far.
As a result of the incident, Mrs. Wang fractured several fingers on her right hand,
injured her shoulder and sustained several other abrasions and contusions to her
body, in addition to the facial injuries above described. Her injuries were such that
reconstructive surgery was required to repair her hand and face. Additionally, her
normal life activities have been impaired significantly and she continues to
experience a serious amount of pain and discomfort.
We hereby notify U.S. Border Patrol of the above incident in the hope of resolving
this matter in an amicable and expeditious manner.
